Duties of the Access and Tariffs Department Directorate

  • Review, evaluate reference access offers, ensure that necessary changes are made where deemed appropriate, make corrections ex officio if such changes are not made, and submit suitable reference access offers for the Board's approval.
  • Operate a reconciliation procedure between parties to resolve disputes arising from access agreements; take measures deemed necessary in the public interest, including the determination of temporary fees, or reject reconciliation requests; in the event that the parties fail to reach an agreement during the reconciliation process, determine the disputed provisions, conditions, and fees of the access agreements.
  • In coordination with relevant units, identify access and interconnection obligations, determine the scope of these obligations and the circumstances under which they will be limited, and make the necessary regulations on the subject.
  • Make regulations to ensure that all access agreements are established and implemented in accordance with the purpose and scope specified in the relevant legislation, the protection of competition and consumer rights, the integrity of networks, interoperability, and the mutual operability of services.
  • Review access agreements and, in the event that agreement provisions are found to be contrary to the relevant legislation and Authority regulations, conduct the necessary procedures to ensure that changes are made.
  • In coordination with relevant units, identify facility sharing and co-location obligations, determine the conditions and fees applicable to operators obliged to provide facility sharing and co-location, and make the necessary regulations in this regard.
  • Determine the procedures and principles to be applied regarding access and, to ensure that agreements signed for the provision of electronic communications do not contain provisions that restrict competition and/or are contrary to legislation or consumer interests, perform the procedures envisaged by the legislation.
  • Determine the procedures and principles regarding the determination, regulation, approval, supervision, monitoring, and notification of the lower and upper limits of tariffs.
  • Make regulations regarding the submission of tariffs to the Authority, their announcement to the public, and their publication.
  • In coordination with relevant units, identify operators to which accounting separation obligations will be imposed, determine the scope of the accounting separation obligation and the procedures and principles for its implementation, make the necessary regulations regarding the audit of the accounts of obliged operators; and, if deemed necessary, publish the information and documents to be submitted to the Authority within the scope of operators' accounting separation and cost accounting obligations, and determine the scope of the information and documents to be published.
  • Perform other duties assigned by the President.
