Postal Sector

Our Institution has been authorized in matters of regulation and supervision of the postal sector under the Postal Services Law No. 6475 (Law No. 6475), which was published in the Official Gazette dated 23/05/2013 and numbered 28655 and entered into force.

Within the scope of Law No. 6475, the duties and powers of our Institution towards the postal sector are listed below:

  • To make the necessary regulations to ensure that postal services are provided to users reliably, uninterruptedly, and at affordable prices in accordance with the policies and strategies to be determined by the Ministry
  • To determine the scope, duration, form, and fees of authorization certificates, to issue and approve authorization certificates, to supervise their implementation, to carry out the necessary operations and procedures in this regard, and to take the measures stipulated in the legislation
  • To determine the methods for the approval, monitoring, and supervision of tariffs, as well as the lower and upper limits of tariffs and the procedures and principles for their application
  • To take the necessary measures in collaboration with relevant administrative units to protect national security, public order, and public health in postal services, and to make regulations for prohibited items to be sent by post and items whose acceptance is conditional
  • To ensure that service providers comply with the specified principles and rules for the purpose of equality, transparency, and ensuring competition in areas outside the postal monopoly, and to supervise or have supervised the compliance of their activities with the authorization terms and conditions, as well as their operational and accounting records
  • In cases of non-compliance with regulations, authorization certificate terms and conditions, service contracts, Authority decisions, and tariffs, to impose administrative fines, to withdraw authorization certificates for a certain period or to cancel them
  • To announce the Authority decisions that concern service providers and users and do not contain confidentiality, to the public in accordance with the procedures determined by the Authority
  • To operate the reconciliation procedure when necessary for the resolution of disputes arising between service providers within the Authority's field of duty and brought to the Authority, and in the event that no reconciliation is achieved, to take the necessary decisions that remain valid until otherwise agreed between the relevant parties
  • To monitor developments in the postal sector, to conduct or have conducted the necessary research to encourage the development of this sector, to cooperate with relevant institutions and organizations on these matters, and to prepare reports
  • To monitor, evaluate, and take necessary decisions regarding the regulations and practices of international institutions and organizations related to the sector
  • To evaluate users' complaints and to take the necessary measures
  • While performing its duties, to request any information and documents it deems necessary from public institutions and organizations, real and legal persons, or to conduct on-site inspections
  • To conduct inspection, examination, and investigation procedures related to the postal sector and to apply sanctions within its authority
  • To monitor, supervise, and take necessary measures regarding the activities related to the execution of the universal postal service in accordance with the determined national or international standards
  • To make regulations aimed at establishing and protecting competition in the postal sector and eliminating anti-competitive, distorting, or restrictive practices
  • To supervise competition violations in the postal sector, to apply sanctions, and, in cases stipulated by the legislation, to obtain opinions from the Competition Authority when necessary regarding competition violations in the postal sector
  • To make all necessary regulations to protect user interests in the postal sector
  • To determine the financial and professional competency requirements for holders of authorization certificates and the minimum infrastructure to be established for this service
  • To make regulations, communiqués, and other legal arrangements regarding the duties and powers given by this Law and to take decisions as deemed necessary
