Electromagnetic Interference (Interference)

The term "Electromagnetic Interference" refers to any type of broadcast or electromagnetic effect that prevents the operation of any system/device provided in accordance with the relevant Law and Regulation/Communiqué, causes interruption in communication, or deteriorates its quality.

"Interfering System" refers to any type of system/device (radio/TV transmitter, walkie-talkie, industrial devices, etc.) that disrupts the operation of other systems by emitting unwanted signals into the air during its operation. 

"Affected System" refers to any type of system/device (radio/TV, walkie-talkie, telephone, signaling systems, etc.) whose operation is prevented or interrupted by unwanted signals during its operation.

For electromagnetic interference applications made to the Information Technologies and Communication Authority or its Regional Directorates via a complaint letter or   BTK-11 Form, necessary actions are initiated following the verification of the complaint's validity (address, phone numbers, obtaining necessary information verbally regarding electromagnetic interference).

In the detection and elimination of electromagnetic interference, extensive use is made of the capabilities of the National Monitor System.

In cases where any transmitter/receiver or other systems are exposed to electromagnetic interference, depending on the purpose and location of use of the affected system or device, the Information Technologies and Communication Authority applies the procedures of granting the specified period below or immediate shutdown to the system causing the electromagnetic interference.

If the system causing electromagnetic interference affects sea or air navigation systems or communications, national/international danger, call or emergency assistance channels, public service institutions concerning country, state, life and property security (emergency services, fire department, transportation, etc.), systems or communications of the Turkish Armed Forces, or the General Directorate of Security, the operation of the said system is immediately stopped without granting any period, by informing the relevant institution in writing.

The authorities of the institution/organization/station causing electromagnetic interference are obliged to send to the Information Technologies and Communication Authority/Regional Directorate a letter stating that the necessary maintenance-repair, filtering, etc. procedures have been performed on their transmitters/devices, or photocopies of invoices for newly purchased devices/units, or a letter to be obtained from the affected institution stating that the electromagnetic interference has been eliminated.

Depending on the purpose of use of the affected system, a reasonable period of 1-30 days is granted to the authorities of the interfering institution/organization/station for the purpose of eliminating the electromagnetic interference.

For the purpose of eliminating electromagnetic interference, the authorities of the institution/organization/station granted a period must have maintenance-repair and tests performed on their transmitters, and send the report to be prepared by the company or the letter to be obtained from the affected institution stating that the electromagnetic interference has been eliminated to the Information Technologies and Communication Authority/Regional Directorate.

If the electromagnetic interference is not eliminated within the granted period or the Test Maintenance Repair Report or the letter to be obtained from the affected institution stating that the electromagnetic interference has been eliminated is not sent to the Information Technologies and Communication Authority, the system/device operation is temporarily stopped by informing the relevant parties in writing until the necessary corrections are made.

For radio/TV stations whose operations are stopped by BTK to resume operations, it is subject to permission from the Information Technologies and Communication Authority. 

During electromagnetic interference investigations, if a system/device installed/used without permission from the Information Technologies and Communication Authority is detected, the operation of the system/device is immediately stopped without conducting any electromagnetic interference investigation.  

In cases where the owners or operators of institutions/organizations/stations whose operations were stopped due to electromagnetic interference resume operations without permission and without eliminating the interference they cause, legal sanctions are applied in accordance with Article 124 of the Turkish Penal Code.

In a situation where an electromagnetic interference application is made, if the electromagnetic interference disappears on its own before any intervention by our Authority, it is necessary to inform our Authority immediately in order to ensure the economical and efficient use of public resources.
