TEY Legislation

Within our Institution, which is the Authorized Public Authority in the telecommunications sector, as part of the harmonization efforts with the European Union under the National Program in the title of "Free Movement of Goods"; the first Radio Equipment (RE) Regulation regarding the RED Directive No. 2014/53 of the European Parliament and of the Council dated 22 May 2014 on radio equipment and the mutual recognition of their conformity, which covers the regulation of conformity assessment procedures in import and manufacturing regimes and CE marking, aims to ensure full liberalization of the Radio and Telecommunications Sector, to enable new devices to enter the market quickly and thus accelerate technological developments, has been prepared and published in the Official Gazette dated 05.11.2020 and numbered 31295.

The subjects regulated by the RE Regulation include;

  • Conditions for placing devices on the market,
  • Market Surveillance and Inspection,
  • Prohibition of placing unsafe devices on the market, their withdrawal or disposal,
  • Conformity assessment procedures,
  • Procedures and principles of operation for Approved Organizations,
  • CE marking,
  • Notifications to be made to the EU Commission, EU member states, and other EU bodies regarding applications are included.

Regulations Made under the RE Regulation:

Notification Form (Class-2) 

Due to the abolition of Class-2 notifications with the RE Regulation, there is no need to make Class-2 notifications for such devices.

Market Surveillance and Inspection

In order to determine the procedures and principles regarding the surveillance and inspection of whether RE is compliant with relevant technical regulations and safe at the stage of placing on the market or distribution or while on the market, the measures to be taken, the duties, powers and responsibilities of the ICTA in market surveillance matters, and the obligations of manufacturers and distributors, the Regulation on Market Surveillance and Inspection of the ICTA has been prepared.

Approved Organizations

In order to determine the procedures and principles regarding Approved Organizations that will carry out conformity assessment activities in the field of radio equipment, the Regulation on Approved Organizations has been prepared and published on 26/02/2004, entering into force on the same date.

Protocol Between TÜRKAK and BTK

Within the framework of the Regulation on Approved Organizations (AO), for the evaluation and inspection of the technical competence, impartiality and independence of AO candidates to be designated by BTK (former Telecommunications Authority) in line with European practices and Turkey's strategies, a Protocol on the Evaluation and Inspection of Approved Organizations Between the Telecommunications Authority and the Turkish Accreditation Agency (TÜRKAK) has been prepared, and the Protocol text was signed by BTK and TÜRKAK, entering into force on 09/12/2003.

Harmonized Standards

The list containing Harmonized European Standards and related Harmonized National Standards is included in the Annex of the Communiqué on Standards Referenced by the ICTA Regulation (2007/1), published in the Official Gazette dated 18/08/2007 and numbered 26617, and entered into force. The said lists are updated and published within the framework of the standards published in the EU Official Journal.
