PROCESS OF RETRIEVING AUTHORIZATION APPLICATIONS FROM THE CEVHER SYSTEM

Applications for initial authorization, additional authorization, authorization renewal, authorization adequacy control period, etc., related to electronic communication services;

Will be conducted through BTK's CEVHER System via the internet address “kurumsal.btk.gov.tr”.
After logging into the “kurumsal.btk.gov.tr” address with an e-Government password, the application process will be initiated by clicking on the “Initial Authorization Application”, “Additional Authorization Application”, and “Renewal/Adequacy/Year-end Obligations” tabs under the “New Request” tab, and the entire process will be conducted through this System.

Changes in the information submitted to our Institution by operators authorized by our Institution within the scope of their authorizations must also be notified through the CEVHER System from the “Operator Information Update” tab. Additionally, for changes in information requiring document submission, the documents substantiating the changes must be uploaded to the System and sent to our Institution.

APPLICATION STEPS FOR AUTHORIZATION

1. In order to be authorized by applying to the Authority through notification or granting of usage right together with notification, the following conditions are required in the company making the application:

Being established as a limited or joint-stock company solely for the purpose of carrying out activities subject to authorization or the activities necessary to provide the service subject to authorization together therewith,
In the articles of association of the company as published in the Trade Registry Gazette where it is registered and announced, there is an expression such as “providing electronic communications service/telecommunications service and/or establishing and operating a network or infrastructure” within the scope of the field of activity or the electronic communications activity for which authorization is requested (The activities listed in the "Purpose and Subject" section of the company's articles of association do not include any service other than electronic communications services and the activities necessary to provide such service (food, automotive, tourism, construction, etc.) (You can access the sample articles of association text from this page.),
Real person partners holding at least ten percent of the company's shares, persons authorized to manage and represent the legal entity, and real person partners holding at least ten percent of the shares of legal entity partners holding at least ten percent of the company's shares have not been convicted with an imprisonment sentence for crimes listed in the Third Part Tenth Section of the Turkish Penal Code dated 26/9/2004 and numbered 5237 regarding information systems crimes, crimes against the security of the State listed in the Fourth Part Fourth Section, crimes against the constitutional order and its functioning listed in the Fifth Section (archived judicial record), except for negligent crimes, for one of the prison sentences exceeding 5 years or crimes committed against private life or hidden areas of life, simple and qualified embezzlement, extortion, bribery, theft, fraud, forgery, abuse of office, abuse of trust, fraudulent bankruptcy and concordat, smuggling crimes, fraud in official tenders and procurement-sales, usury, money laundering, tax evasion or participating in tax evasion, or under the first and second paragraphs of Article 63 of the Electronic Communications Law numbered 5809 (archived judicial record),
Its paid-in capital is at least the minimum amount determined by the Authority (The paid-in capital of the company shall be 250,000 TL for OKTH authorization, and 1,000,000 TL for other authorizations, pursuant to the Board Decision dated 31/03/2016 and numbered 2016/DK-YED/195),
No judicial process has been initiated by the Authority against the company or its partners or persons authorized to manage and represent the legal entity within the scope of the first and second paragraphs of Article 63 of the same Law due to establishing, operating an electronic communications facility or providing electronic communications service in contravention of the provisions of Article 9 of the Electronic Communications Law numbered 5809,
Except for the provisions regarding non-re-authorization in the Regulation on Administrative Sanctions of the Information Technologies and Communication Authority, the authorization of the company or companies established by partners holding at least ten percent (%10) of the company's shares, members of the board of directors, and persons authorized to manage the legal entity has not been canceled due to non-compliance with relevant legislation in the last three years, and the reason(s) for the relevant termination/cancellation regarding a company whose authorization has been canceled at any time due to non-compliance with relevant legislation have been eliminated,
Sending the information and documents requested in the notification and/or usage right application form determined by the Authority to the Authority (You can access the Notification and Usage Right Application Forms from this page. The documents required together with these forms are listed in the "Annexes" section of the relevant forms. Applications with missing information (address, telephone, KEP address, etc.) and documents related to the company will be rejected.)

2. In authorizations related to usage rights with limited number, the other application conditions except for paragraph (a) of the first paragraph are required. In addition;

Except for the provision of paragraph (a) of the first paragraph of the Transitional Article 4 of the "Authorization Regulation", the applicant company is established as a joint-stock company solely to carry out activities within the scope of authorization or activities such as device sales, installation, maintenance-repair, and consultancy that are necessary and/or related to providing the service subject to authorization according to the laws of the Republic of Turkey or will be established within the period specified in the relevant tender specification,

All shares of the joint-stock company are registered shares,

Meeting the conditions foreseen in the relevant legislation and/or tender specification,

are required.

3. Applications that do not meet the conditions specified in the first and second paragraphs and/or are not made in accordance with the notarized signature circulars are deemed invalid.

4. During the authorization period of the operator, except for the Authority regulations reserved, it is mandatory to meet the conditions specified in the first and second paragraphs; in case of losing these conditions or it is later determined that these conditions are not met, the Authority notifies to fulfill the necessary conditions by giving an appropriate period according to the nature of the situation. If the situation is not corrected at the end of the period, the authorization is canceled.
