Frequencies Usable in Civilian UAVs

Subject to the obligation to comply with the conditions specified in Article 8 of the Electronic Communications Law No. 5809 (ECL) (within their own immovable properties and without exceeding the boundaries of each immovable property, exclusively for personal or institutional needs and not to be used in providing any electronic communication service to third parties, no commercial purpose pursued in its provision, and not offered for public use);

In our country, regarding the exemption from radio license, radio installation and use permit, and frequency allocation and registration procedures, including for UAVs; matters are determined by the "Regulation on Radio Devices and Systems Exempt from Frequency Allocation" published in the Official Gazette dated 27/11/2018 and numbered 30608, and the provision in the first paragraph of Article 6 of the said Regulation stating "Technical Criteria are determined by the Authority and published on the Authority's official website." within the framework of the "Technical Criteria Regarding Radio Devices and Systems Exempt from Frequency Allocation" (Technical Criteria) arrangement.

In this context, the obligations of manufacturers / importers / authorized representatives / distributors under Article 17 of the "Radio Equipment Regulation (2014/53/EU)" are reserved; A UAV containing radio equipment,

a. If it has the 'CE mark' on its packaging and user manual but does not have a 'warning pictogram (!)' or 'warning regarding usage restrictions/necessity to obtain usage permit', it can be used by individuals without the need to apply to our Authority for frequency allocation or permit,

b. If it does not meet all the conditions specified in clause (a) (even if it has the CE mark), it cannot be used as no frequency allocation is made by our Authority.

For device uses made without complying with these obligations; proceedings are carried out within the framework of Article 63 of the ECL No. 5809 titled "Penal Provisions" and other relevant legislation.
