Facility Sharing Amendment
Facility sharing is the service of providing other operators with access, for a fee, to passive infrastructure such as pipes, ducts, and poles owned by electronic communications network operators. Sharing existing facilities such as pipes, ducts, and poles during the installation of next-generation networks required to deliver high-speed broadband services to end-users is of great importance in terms of efficient use of resources and avoiding duplicate investments.
In this context, as a result of the studies conducted by the Information Technologies and Communications Authority, Board Decision dated 12/04/2013 and numbered 2013/DK-ETD/187 has made all operators authorized to establish and operate fixed electronic communications infrastructure subject to the obligation to share their pipes, ducts, and poles with other operators upon request, effective from 01/09/2013. The "Procedures and Principles Regarding the Evaluation of Facility Sharing Requests and the Provision of the Service" containing the implementation details of the said obligation was revised by Board Decision dated 29/07/2015 and numbered 2015/DK-ETD/359, effective from 01/09/2015.
In addition, Board Decision dated 12/04/2013 and numbered 2013/DK-SRD/188 has imposed on Türk Telekomünikasyon A.Ş., designated as the operator with significant market power in the wholesale physical network infrastructure access market, the obligation to prepare a reference offer containing the procedures, principles, and fees for providing facility sharing at cost-based prices for "access to subscribers" and "backhaul connections within Interconnection, Unbundled Local Access to the Network, Data Flow Access, and Partial Leased Circuit services (transporting traffic delivered at Türk Telekom central buildings to their own points of presence)," and to provide the said service. Within this scope, the Türk Telekom Reference Facility Sharing and Unlit Fiber Offer (ReTPAFT) was last approved by Board Decision dated 29/07/2015 and numbered 2015/DK-ETD/359, effective from 01.09.2015.
On the other hand, with Board Decision dated 13.09.2017 and numbered 2017/DK-ETD/265 taken within the scope of establishing and activating the Electronic Communications Infrastructure Information System and increasing the efficiency of processes related to facility sharing, it has been decided that facility sharing requests be first submitted to our Authority for evaluation and that the processes for evaluating and finalizing facility sharing applications submitted to the Authority be determined by our Authority. Accordingly, in order for projects related to electronic communications infrastructure installation to be evaluated in terms of facility sharing, they must first be submitted to our Authority, and within this framework, the Facility Sharing Request Form under section 6 of Annex-3 of ReTPAFT must be fully completed by the operators making the application and sent to our Authority together with the following information;
1) Name, address, and/or coordinate information of the endpoints of the route subject to the facility sharing request (in CD in formats specified in the Project Data Acquisition Guide),
2) Additional explanations regarding the route information,
3) Information on the scope of services to be provided over the requested route, how and with what types of devices/cables they will be provided.
At this stage, the applicant operator does not need to send additional information to the infrastructure owner operator beyond the information submitted to our Authority, and the processes related to the subsequent stages starting from the site survey (including notification of the site survey fee and duration to the applicant operator) must continue to be carried out by the parties in accordance with the provisions in the relevant documents. Within this scope, following the application of the facility sharing requesting operator to the infrastructure owner operator, the infrastructure owner operator must calculate and notify the site survey duration and fee to the facility sharing requesting operator within 15 days together with bank account details.
As a result, operators will first notify their facility sharing requests to our Authority for evaluation, and subsequent processes and transactions will be conducted with Türk Telekom under ReTPAFT for facility sharing requests aimed at "access to subscribers" or "transporting traffic delivered at Türk Telekom central buildings to their own points of presence within Interconnection, Unbundled Local Access to the Network, Data Flow Access, Partial Leased Circuit services," and for other facility sharing requests, with the relevant infrastructure owner operators under the "Procedures and Principles Regarding the Evaluation of Facility Sharing Requests and the Provision of the Service" document last revised by Board Decision dated 29/07/2015 and numbered 2015/DK-ETD/359.
