Electronic mail, which is widely used for sharing information and documents in electronic media, is an important tool as it enables business processes and transactions to be conducted faster and more easily. However, for communication via electronic mail to be technically secure and legally valid between the parties, additional security services are required. Registered Electronic Mail (KEP), developed to meet these needs, is the qualified form of electronic mail that provides legal evidence regarding the use of electronic messages, including their sending and delivery. Services related to the KEP system are provided by Registered Electronic Mail Service Providers. In addition to sending and receiving electronic messages within the KEP system, value-added services such as storage of electronic documents, secure communication, and reliable third-party services in electronic media can also be offered.
For the first time in our country's legislation, reference to the registered electronic mail system was made with the Turkish Commercial Code No. 6102 dated 13/1/2011, stipulating that electronic notifications or warnings between merchants—related to putting the other party in default, terminating the contract, or withdrawing from the contract—shall be made through the registered electronic mail system. Furthermore, the same Code grants the Information Technologies and Communication Authority the authority and duty to issue secondary regulations regarding the KEP system.
