Authorization Regime

With the entry into force of Law No. 6475 on Postal Services, it has been stipulated that postal services covering the acceptance, collection, processing, transportation, distribution, and delivery of postal items may only be provided by service providers operating in accordance with the provisions of this Law.

According to the definition in Law No. 6475, service providers are defined as the Post and Telegraph Corporation Joint Stock Company and the capital companies listed in the second paragraph of Article 124 of the Turkish Commercial Code No. 6102 dated 13/01/2011, authorized to operate in the postal sector in accordance with the provisions of this Law.

Therefore, in order to provide postal services or to establish and operate the necessary infrastructure for this purpose in accordance with Law No. 6475, it is required to be authorized by the Authority in this regard. Authorization will be granted by the Authority issuing authorization certificates to companies.

Companies wishing to obtain an authorization certificate must meet the conditions set forth in Article 6 of the "Authorization Regulation on the Postal Sector," which was published in the Official Gazette dated 03/06/2014 and numbered 29019 and entered into force, and must deposit the authorization fee determined for the geographical scope in which they wish to operate.

The Authority will issue authorization certificates to companies that apply in accordance with the relevant legislation and whose applications are deemed appropriate by the Authority, with the geographical scope on a national or provincial/provinces basis as per their requests. Companies granted authorization certificates by the Authority will hold the status of service providers during the validity period of their authorization certificates and will be subject to the rights and obligations in accordance with the relevant legislation.

Service providers authorized at the national level are authorized to provide postal services and/or to establish and operate the necessary infrastructure nationwide; service providers authorized at the provincial level, within the boundaries of the province for which they are authorized; service providers authorized in multiple provinces, within the boundaries of those provinces and between such provinces. Service providers authorized at the provincial/provinces level cannot accept domestic postal items whose delivery address is outside the province/provinces for which they are authorized.
