Radio Equipment Directive (RED)

In our country, market surveillance and inspection activities are conducted within the scope of the Radio and Telecommunications Terminal Equipment Regulation (1995/5/EC), which was harmonized and published under the R&TTE Directive prepared for radio and telecommunications terminal equipment within the framework of European Union (EU) harmonization laws. However, the EU has decided to amend the R&TTE Directive for purposes such as eliminating existing uncertainties, reducing unnecessary administrative burdens on economic operators, facilitating the use of products with a common charger for mobile phones and other portable devices, and preventing environmental pollution.

Taking new needs into account, the Radio Equipment Directive (Radio Equipment Directive/RED), which will replace Directive 1999/5/EC on R&TTE, was adopted on April 13, 2014. The European Union approved Directive 2014/53/EU on Radio Equipment (RE) and published it in the Official Journal of the EU on 22/05/2014. EU member states, candidate countries, and European Free Trade Association (EFTA) countries are obliged to update their national legislation by June 12, 2016, when the R&TTE Directive will be repealed, and to implement the RE Directive from June 13, 2016 onwards. A one-year transition period was applied to meet the requirements of the Directive, and this transition period ended on June 12, 2017.

Work on the harmonization of the RE Directive and its transposition into national legislation began at the end of 2015. The regulation harmonization studies were completed following consultations with the European Commission, and the Radio Equipment Regulation was published in the Official Gazette dated 05.11.2020 and numbered 31295, entering into force. A three-month transition period was granted to ensure a smooth transition for manufacturers.

The following provisions in the current Regulation in force have been removed:

  • Provisions regarding terminal equipment,
  • Provisions regarding Class 2 notification,
  • Conformity assessment module in Annex-3

have been removed.

  • In addition to human health and safety, provisions regarding pet health and safety and protection of property,
  • Provision regarding common charger,
  • Provisions regarding software-hardware conformity,
  • Provisions regarding database registration for device types with high non-conformity rates,
  • Definition of economic operator,
  • Provisions regarding obligations of manufacturers, authorized representatives, importers, and distributors,
  • Provisions regarding situations where manufacturer obligations apply to importers and distributors,
  • Procedures to be followed for radio equipment posing risks at national level,
  • Provisions regarding radio equipment used solely for receiving sound and TV broadcasting services and operating as receivers,
  • Provisions regarding EU declaration of conformity and technical documentation

have been introduced with the new Regulation.
