Fixed Telephone Service End User Tariffs
In light of the analysis and evaluations conducted regarding the retail-level fixed call services market, it has been assessed that ex-ante regulatory measures and, within this scope, the identification of Significant Market Power (SMP) are not necessary in the relevant market for call services on fixed networks; therefore, there are no retail-level obligations in the aforementioned market. However, paragraph (a) of the second paragraph of Article 13 titled “Regulation of Tariffs” of the Electronic Communications Law No. 5809 provides: “Operators shall freely determine the tariffs they will apply, provided that they do not contradict the relevant legislation and Authority regulations.” Within this scope, operators providing fixed telephone services can freely determine their retail tariffs, subject to compliance with the relevant legislation and Authority regulations.
